1. General Terms
By accessing this website and using our services, you agree to comply with these Terms & Conditions. These terms govern all services, proposals, quotations, invoices, projects, and agreements provided by Firm Fluid.
Any service requested outside the approved scope shall be considered additional work and may be billed separately.
All communications conducted via email shall be considered official communication.

- Client shall provide all required content, images, logos, branding materials, credentials, and project requirements.
- Project timelines depend on timely approvals, content availability, and client cooperation.
- Any delay from the Client may result in revised delivery timelines.
- The approved proposal shall define the project scope.
- Any new design, feature, functionality, page, integration, or requirement outside the approved proposal shall be charged separately.
- The Business reserves the right to charge additional fees for custom development, API integrations, third-party integrations, and extra revisions.
- Only the revisions included in the approved proposal shall be provided. Additional revisions may incur extra charges.
- Website delivery, source files, credentials, and final handover may be withheld until all payments are completed.
- Ownership of website files, source code, designs, and project assets shall remain with the Business until full payment is received.
- The Client shall be responsible for domains, hosting, licenses, premium themes, plugins, and third-party subscriptions unless otherwise agreed.
- The Business shall not be responsible for server issues, hosting failures, malware attacks, hacking, downtime, data loss, or third-party service interruptions.
- The Client is solely responsible for the legality, accuracy, and ownership of all content provided.
- The Business reserves the right to suspend work if payment milestones are overdue.
- All token amounts, advance payments, and booking fees are strictly non-refundable.
- If the Client cancels, pauses, or terminates the project after work has commenced, payments already made shall not be refunded.
- If the Client remains unresponsive for 30 consecutive days, the project may be marked as inactive and closed.
- Inactive projects may require a new proposal, revised pricing, and reactivation charges before work resumes.
- Maintenance, updates, backups, security monitoring, and future support are not included unless specifically mentioned in the proposal.
- The Business does not guarantee any specific sales, leads, traffic, rankings, revenue, or business results.
- The Client shall review and approve all website content before publication.
- The Business shall not be liable for delays caused by circumstances beyond reasonable control, including technical failures, cyber attacks, natural disasters, or government restrictions.
- The Business provides development services for custom websites, WordPress, WooCommerce, Shopify, and related web platforms.
- Premium themes, plugins, Shopify apps, WooCommerce extensions, APIs, third-party software, and paid tools are not included unless specifically mentioned in the approved proposal.
- The Client shall be responsible for domain renewals, hosting renewals, theme licenses, plugin licenses, Shopify subscriptions, app subscriptions, and third-party service charges unless otherwise agreed.
- The Business shall not be responsible for issues arising from third-party themes, plugins, apps, extensions, platform updates, or external service providers.
5. Digital Marketing Services
Marketing performance depends on numerous factors including industry, budget, competition, audience behavior, and market conditions.
Firm Fluid does not guarantee specific sales, leads, conversions, revenue, ROI, rankings, or business outcomes.
Advertising costs for Google Ads, Meta Ads, LinkedIn Ads, YouTube Ads, and other platforms remain the responsibility of the client unless otherwise agreed.

Search engine rankings cannot be guaranteed.
SEO performance depends upon website condition, competition, content quality, search engine algorithms, and market trends.
SEO is a long-term strategy and visible results may require several months.

Content creation, publishing schedules, graphics, captions, and campaign management shall be provided according to the selected package.
Additional content requests beyond the agreed scope may incur extra fees.
The client remains responsible for final approval before publication.

The client is responsible for compliance with WhatsApp, Meta, and applicable legal requirements.
Firm Fluid shall not be responsible for restrictions, suspensions, account bans, or policy actions imposed by third-party platforms.
Message delivery rates may vary depending on platform policies and recipient behavior.

Candidate sourcing and recruitment assistance shall be provided according to the agreed service terms.
Final hiring decisions remain solely the responsibility of the client.
Firm Fluid does not guarantee candidate joining, retention, performance, or employment duration.
Replacement policies, if applicable, shall be governed by the recruitment agreement.

A token amount may be required before commencement of work.
Payment schedules shall be governed by the proposal, quotation, invoice, agreement, or written communication shared with the client.
Failure to complete agreed payment milestones may result in suspension of services, project delays, withholding of deliverables, or termination of services.
Additional work outside the approved scope shall be billed separately.
All invoices shall be payable within the time period specified in the invoice.

All token amounts paid towards project initiation, consultation, development, recruitment, marketing, design, planning, or strategy services are strictly non-refundable.
Once work has commenced, payments made towards services rendered shall not be refundable.
Refund requests, if any, shall be reviewed solely at the discretion of the Business and subject to agreed contractual terms.

All source code, designs, graphics, documents, reports, strategies, databases, marketing assets, and project files remain the property of the Business until full payment has been received.
Ownership shall transfer to the client only after complete settlement of all outstanding dues.
The Business reserves the right to showcase completed projects in its portfolio unless otherwise agreed in writing.

The Business shall not be liable for indirect, incidental, consequential, special, business, financial, reputational, or data-related losses arising from the use of its services.
The maximum liability of the Business shall be limited to the amount paid by the client for the specific service giving rise to the claim.
